2. Acceptance of the Terms

  1. A User intending to use the Service must accept these Terms before commencing use.
  2. Acceptance of the Terms is deemed to be any of the following actions by the User: registration on the Site, authorisation on the Site (including via third-party services), or commencement of use of the Service in any other manner.
  3. Upon acceptance of the Terms, the User confirms that they have the requisite legal capacity and, under the law applicable to them, are not restricted from accepting these Terms and using the Service.
  4. Acceptance of these Terms subject to conditions or reservations is not permitted. Acceptance means acceptance of the Terms in full.
  5. Acceptance of these Terms is possible upon simultaneous fulfilment of the following conditions:
    1. careful reading by the User of all provisions of these Terms;
    2. the User's agreement to comply with all provisions of these Terms;
    3. careful reading of, and agreement by the User with, the Privacy Policy and other related documents posted on the Site.
  6. By accepting the Terms, the User also accepts the Agency Agreement and other related documents posted on the Site and forming an integral part of the Terms.
  7. By accepting these Terms, the User represents and warrants that:
    1. they have read the full text of the Terms and its provisions are clear to them;
    2. the information they provide upon registration and use of the Service is accurate;
    3. they use the Service in good faith and for its intended purpose;
    4. their use of the Service does not infringe the rights of third parties and does not contravene the law applicable to them, including in respect of age and other restrictions;
    5. they are solely responsible for compliance with the tax, currency and other law applicable to them.
  8. If the User has not reached the age at which, under the law applicable to them, they may independently enter into transactions, use of the Service is permitted only with the consent of their legal representative, who in that case accepts these Terms and is responsible for the User's actions.

3. Subject of the Terms

  1. The Administration grants the User the right to use the Site, while retaining the Administration's right to grant licences to third parties (a non-exclusive licence), on the terms and to the extent set out in these Terms, and also provides the User with the Administration's Own Services in accordance with Section 5 of the Terms.
  2. Two types of services are available to the User within the Service:
    1. the Administration's Own Services - services provided directly by the Administration. Such services are activated automatically after the debit of the corresponding number of Accounting Units from the User's Balance;
    2. User Services - services provided by some Users to other Users (including services provided on game servers). In this case the Administration acts as an agent and is not a party to the transaction between the Users. The procedure for the provision of and settlement for such services is determined by the Agency Agreement.
  3. The User uses the Site independently, without the direct involvement of the Administration, in accordance with the functionality of the Site.
  4. The Administration provides technical support and updates to the Site. An updated Site may contain error and defect fixes, as well as new or modified functions.
  5. The Service may operate on several domains oriented towards different regions. Access to them is carried out using a single User Account. The terms of provision of services, methods of topping up the Balance and the applicable Accounting Units in other segments of the Service are governed by separate documents posted in the respective segments. Internal Accounting Units of the User's various Balances may be recalculated between one another at the internal rate set by the Service; such recalculation does not constitute a currency exchange and does not give rise to any monetary claims of the User against the Service.

4. Remuneration under the agreement and cost of services

  1. Registration is carried out by the User automatically (without the involvement of the Administration) in the manner provided on the Site, including through authorisation via third-party services.
  2. Registration is not possible without the User's agreement to the Terms. By registering, the User expresses full and unconditional agreement with the Terms.
  3. Access to the Account is by login and password or through authorisation via third-party services. The User undertakes to keep the password and access data confidential. All actions performed from an authorised Account are deemed to have been performed by the User.
  4. The User's Personal Cabinet includes a public and a private part. The public part contains information available to other Users (including nickname, avatar, identifier, registration date, level, achievements and gifts received). The private part is available to the User themselves and may include, in particular:
    1. pages of the Administration's Own Services;
    2. the Game Server management page allowing the User to add and display Game Servers belonging to them;
    3. functionality for creating and managing a Project combining the owner's Game Servers (in the manner determined by the Agency Agreement);
    4. the User's Balance, taking into account Accounting Units of various kinds;
    5. pages of achievements and gifts, friends list, history of operations and actions;
    6. profile and data settings (linking of e-mail, third-party service accounts, password creation);
    7. the technical support section.
  5. The list of Personal Cabinet functions may be changed and supplemented by the Administration unilaterally.

5. The Administration's Own Services

  1. The Administration's Own Services are provided directly by the Administration and are activated automatically after the debit of the corresponding number of Accounting Units from the User's Balance.
  2. The Administration provides, in particular, the following types of Own Services:
    1. colour highlighting of a server in the ranking;
    2. placement in the «Featured Servers» block;
    3. priority server polling;
    4. the VIP service package;
    5. the extended version of the social-network application;
    6. rental of server equipment and hosting services;
    7. the Premium, Premium PRO and Premium MAX statuses;
    8. gifts to Users (transferred by Users to one another);
    9. placement of information, collection and processing of statistics, application services;
    10. development, adaptation and modification of web pages;
    11. other services and works relating to setup, consulting and support.
  3. The list of Own Services, their composition and conditions of provision are indicative. The complete and current list of Own Services, their description and cost are in all cases reflected directly in the Service interface and prevail overthe information set out in these Terms.
  4. The cost of Own Services is specified in Accounting Units of the Service, is final and is stated inclusive of possible commissions, licence fees and other components. The cost is reflected in the Service interface and may depend on the period for which the service is provided.
  5. The cost and composition of Own Services may be changed by the Administration unilaterally without prior notice by amending the relevant information in the Service interface. Changes apply to operations performed after their posting and do not require amendments to the text of these Terms.
  6. The User understands and agrees that the functionality and services of the Service described in these Terms are indicative, and that their complete and current description is always contained directly in the Service interface. The User is not entitled to demand from the Administration the provision of functionality or services (or a refund for their absence) that were not provided for in the Service interface at the time of the operation, even if such functionality or service was specified in the text of these Terms. The information contained in the Service interface prevails in all cases over the information specified in these Terms, to which the User fully agrees.
  7. The provision of services not expressly provided for by these Terms and the Service interface is not included in the cost of Own Services.

6. Procedure for Ordering and Provision of Own Services

  1. To order an Own Service, the User performs the following actions:
    1. reviews the provisions of these Terms and the Privacy Policy;
    2. reviews the description and cost of the relevant service reflected in the Service interface;
    3. if there are questions regarding the terms, procedure of provision or payment for services, contacts the technical support service;
    4. if necessary, tops up the Balance by an amount sufficient to pay for the selected service;
    5. initiates the purchase of the service via the corresponding functionality of the Site.
  2. By initiating the purchase of a service, the User confirms that its content, procedure of provision and cost are clear to them.
  3. An Own Service is deemed provided from the moment of its activation (the provision of the corresponding function or status) after the debit of Accounting Units from the Balance. No service acceptance acts are signed.
  4. Acceptance of a service is deemed to occur where the User raises no complaints within 5 (five) days from its activation. Upon expiry of that period, the service is deemed to have been provided properly and in full.
  5. For services the provision of which presupposes a certain period (placement, highlighting, statuses and the like), the service is deemed to be provided continuously throughout the paid period, irrespective of the User's actual use of the corresponding function.

7. Accounting Units and Payment Terms

  1. Any payment in favour of the Service is voluntary and is made only from the User's own means of payment. A payment provider's commission may be added to the payment.
  2. Upon topping up the Balance, Accounting Units are credited to the User. Accounting Units are not funds, electronic money or a means of payment, have no independent monetary or financial value and are intended for operations solely within the Service. Accounting Units are not subject to exchange or withdrawal by the User, except for the refund of unused prepayment under Section 8 of these Terms.
  3. Accounting Units of various kinds may be recorded on the User's Balance, including those displayed as expressed in various currencies. The recalculation of Accounting Units of one kind into Accounting Units of another kind is carried out at the internal rate set by the Service and does not constitute a currency exchange. Bonus Accounting Units accrued for participation in votes, activities and other actions on the Service are not acquired for money, are not subject to withdrawal or exchange for money and do not give rise to any monetary obligations of the Administration. All matters relating to bonus Accounting Units provided to the User in connection with the provision of services by another User (including on a game server) are resolved solely with the User who provided them (the owner of the relevant game server).
  4. When making a payment, the User must independently review the payment terms of the payment systems through which the payment is made. The User is solely responsible for the accuracy of the data entered when paying. The Administration is not responsible for the operation of payment systems or possible failures in their operation.
  5. Payment for Own Services is made by debiting Accounting Units from the Balance. Where payment documents (receipts or confirmations) are issued in respect of Own Services, they are generated at the moment the User purchases the relevant service (the debit of Accounting Units from the Balance), and not at the moment of topping up the Balance. Payments are processed by the payment provider engaged by the Administration.
  6. All costs associated with making a payment are borne by the User.

8. Refunds

  1. The return of unspent accounting units credited when replenishing the Balance with monetary funds may be made in full, in the portion not used to pay for services, in accordance with the procedure established by the Administration. Partial return of unspent Accounting Units is not permitted.
  2. Unused accounting units are refunded if the user wishes to discontinue further use of the Service.
  3. Accounting Units spent on payment for Own Services are non-refundable, since the relevant service is deemed provided at the moment of its activation.
  4. Bonus Accounting Units are not subject to refund or monetary compensation.
  5. The procedure for refunds in respect of User Services provided by Game Server owners is determined by the Agency Agreement.
  6. No refund is made where the debit of Accounting Units resulted from the User's breach of these Terms or the application of restrictive measures to the User.

9. Rights and Obligations of the Parties

  1. The rights granted to the User include the right to directly use (operate) the Site and exclude any rights to copy and further use any intellectual property of the Administration (including text, images, video).

11. Intellectual Property

  1. All intellectual property posted on the Site and used in the Service (including program code, design, graphic elements, texts, databases and other objects) belongs to the Administration or is used by it on a lawful basis and is protected in accordance with applicable law.
  2. Granting the User access to the Service does not mean the transfer to them of rights to any intellectual property and does not grant the User the right to use such objects beyond the scope provided for by these Terms.
  3. The User is prohibited from copying, reproducing, reworking, distributing or otherwise using the Administration's intellectual property beyond the scope of the Service's functionality without the prior written consent of the Administration.
